The operator of this website takes the protection of your personal data very seriously. We treat your personal data as confidential and in accordance with the statutory data protection regulations.

Right to data portability
You have the right to have data which we process automatically based on your consent or in fulfillment of a contract delivered to yourself or an authorized third party in a standard, machine-readable format. If you require the direct transfer of the data to another Controller, this will only be done to the extent that this is technically feasible and justifiable in terms of expenditure.

Information, blocking, deletion
You have the right to information free of charge about your stored personal data, its origin and recipients and the purpose of data processing and, where appropriate, a right to have the data corrected, blocked or deleted at any time within the scope of the applicable legal provisions. Objection against advertising e-mails
We herewith object to the use of contact data published in the context of website legal notice requirements to send unsolicited advertising and information materials. The operator of these pages expressly reserves the right to take legal action in the event of the receipt of unsolicited advertising material as, for example, in the form of spam e-mails.

 

3. Data collection on our website

When you visit our website, we record and store the IP address assigned to your computer to transmit the contents of our website that you have accessed to your computer (e.g. texts, images and files made available for download, etc.) (cf. Art. 6 para. 1 lit. b of the GDPR). We also process this data to identify and track abuse. In this respect, the legal basis is Art. 6 para. 1 lit. f of the GDPR. Our legitimate interest in data processing is to ensure the proper functioning of our website and the transactions conducted on it.

Transfer to third parties
As a rule, your data will be forwarded to the relevant department of SKS Welding Systems GmbH where it will be further processed depending on the services you require.
Information may be processed by subsidiaries of SKS Welding Systems GmbH, but only to the extent necessary for the purposes stated in this Data Protection Statement or if the other company acts as a service provider or processor bound by instructions.
Service providers located in Germany process the data on our behalf. External service providers are carefully selected and regularly reviewed by us to ensure that your privacy is protected.
The providers commissioned by us are obliged by us to treat your data exclusively in accordance with applicable data protection law (at least GDPR).
The transfer of data to processors is based on Art. 28 para. 1 of the GDPR.
Your personal data will be forwarded without your explicit consent to the law enforcement authorities or, if necessary, to injured third parties if this is necessary in the context of clarifying an unlawful use of our services or for the purposes of legal prosecution.
Within the scope of our legal obligation towards public authorities, data can be passed on if so requested. Examples include law enforcement authorities and tax authorities.

Planned data transmission to third countries
A transfer to third countries is done personalized exclusively for further processing at our subsidiaries and unpersonalized to service providers to enhance the user experience.
Further transmissions are made exclusively within the scope of legal requirements.

Contact form
If you send us inquiries using the contact form, your details from the inquiry form, including the contact data you provided there, will be stored by us or our subsidiaries for the purpose of responding to the inquiry and any follow-up questions in the same context. All you need to do is send us an informal e-mail. The legality of the data processing operations completed up to your revocation remains unaffected by the revocation.
We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request).  Any mandatory statutory provisions, in particular those regarding statutory retention periods, remain unaffected by this provision.

Registration on this website
You can register on our website to access additional functions offered here. The input data will only be used for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration.
To inform you about important changes such as the scope of the offer or technically necessary changes, we will use the e-mail address provided during registration.

Processing of data (customer and contract data)
We collect, process, and use personal data only to the extent necessary to establish, design or modify legal relationships with us (master data). This is done based on Art. 6 (1) (b) GDPR, which permits the processing of data to fulfill a contract or for measures preliminary to a contract. We collect, process and use your personal data concerning the use of our website (usage data) only to the extent required to enable you to access our service or bill you for the same.
Collected customer data shall be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

4. Analytics and advertising

Matomo (formerly Piwik)
This website uses the open source web analytics service Matomo. Matomo uses so-called "cookies". These are text files that are stored on your computer and allow an analysis of your use of the website. For this purpose, the information generated by the cookie about the use of this website is stored on our server. The IP address is anonymized before it is stored.
Matomo cookies remain on your device until deleted.
The storage of Matomo cookies is based on Art. 6 para. 1 lit. f of the GDPR. The website operator has a legitimate interest in anonymized analysis of user behavior in order to optimize both its website and advertising activities.
The information generated by the cookie about the use of this website will not be disclosed to third parties. Use of Facebook Pixel and Facebook Custom Audiences 
On our website, the so-called Facebook pixel of the company Facebook (Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) is used. This classifies visitors to our website into specific target groups for the purpose of controlling advertising on Facebook. The data collected (e.g. IP addresses, web browser info, location data, buttons clicked, pixel IDs if applicable and additional characteristics) is not visible to us, it is only used in the context of displaying certain advertisements. We also use Facebook's Custom Audiences remarketing function. For data exchange, your browser automatically establishes a connection with Facebook servers. We then no longer have any influence over the scope and further use of the data. Facebook is responsible for further data processing. With the use of Facebook Custom Audiences, Facebook receives the information that you have visited a corresponding web page of our website or viewed an ad from us. With your registration with Facebook, your visit can be assigned to your account. In the event that you are not registered with Facebook or are not logged in, the provider can obtain and store your IP address and other identifying features. We use these functions to provide you with advertising offers that correspond to your interests. Teams
We use the tool "Microsoft Teams" to conduct conference calls, online meetings, video conferences, teamwork in workspaces and webinars (hereinafter: "online meetings"). "Microsoft Teams" is a service of Microsoft Corporation.  When using "Microsoft Teams", various types of data are processed. The scope of the data also depends on the data you provide before or during participation in an "online meeting".

The following personal data is subject to processing: User information: e.g. display name, e-mail address if applicable, profile picture (optional), preferred language Meeting metadata: e.g. date, time, meeting ID, telephone numbers, location Text, audio and video data: You may have the option of using the chat function in an "online meeting". To this extent, the text entries you make are processed in order to display them in the "online meeting". In order to enable the display of video and the playback of audio, the data from the microphone of your terminal device and from any video camera of the terminal device will be processed accordingly for the duration of the meeting. You can turn off or mute the camera or microphone yourself at any time through the "Microsoft Teams" applications. We use "Microsoft Teams" to conduct "online meetings." If we want to record "online meetings", we will transparently tell you in advance and ask for consent.
If it is necessary for the purposes of logging the results of an online meeting, we will log chat content. However, this will usually not be the case.  Automated decision-making within the meaning of Art. 22 DSGVO is not used.

This notice is provided in connection with the processing of personal data in connection with the use of "Microsoft Teams".

6. Plug-ins and Tools

hCaptcha
We use “hCaptcha” (hereinafter referred to as “hCaptcha“) on this website. The provider is Intuition Machines, Inc., 2211 Selig Drive, Los Angeles, CA 90026, USA (hereinafter referred to as “IMI”).

 

hCaptcha is being used to determine whether the entry of data into this website (e.g., into a contact form) is being processed by a person or an automated program. For this purpose, hCaptcha analyzes the behavior patterns of website visitors on the basis of several characteristics.

 

This analysis begins automatically as soon as the website visitor enters a website with the activated hCaptcha feature. For the analysis, hCaptcha uses a wide range of information (e.g., the IP address, time spent on the website or mouse actions taken by the user). The data recorded during this analysis is forwarded to IMI. If hCaptcha is used in the “invisible mode,” the analyses are completely conducted in the background.
